Effective August 6, 2026
These Terms & Conditions govern your use of DFWExcavation.com. By using this website, you agree to these terms. If you do not agree, please do not use the website.
Website information
The information on this website is provided for general informational and marketing purposes. We make reasonable efforts to keep it accurate, but site conditions, project requirements, availability, pricing, schedules, laws, permitting requirements, and other factors can change. Website content should not be relied upon as engineering, surveying, environmental, legal, or other professional advice.
Estimates, proposals and project agreements
Nothing on this website constitutes a bid, estimate, offer to perform work, guarantee of availability, or binding construction contract. Sending us a message, plans, photographs, or project information does not create a contractor-customer relationship or obligate either party to proceed.
Any project we agree to perform will be governed by the applicable written estimate, proposal, scope of work, contract, change order, or other project document accepted by the parties. If a project agreement conflicts with these website terms, the project agreement controls with respect to that project.
Site conditions and project information
Excavation, demolition, clearing, grading, drainage, and site-preparation work can be affected by conditions that are not visible or known before work begins, including utilities, subsurface materials, groundwater, buried structures or debris, access limitations, environmental conditions, permitting requirements, weather, and information supplied by owners or third parties. Project-specific responsibilities, assumptions, exclusions, and adjustments will be addressed in the applicable project documents.
Permits and third-party information
References to permitting, utilities, disposal, drainage, soil conditions, construction methods, or other regulatory or technical matters are general in nature unless expressly included in a written project agreement. Property owners and project participants remain responsible for the obligations assigned to them in the applicable project documents and by law.
Intellectual property
The website's design, text, graphics, photographs, videos, logos, branding, and other content are owned by or licensed to DFW Excavation and are protected by applicable intellectual-property laws. You may view and print reasonable portions for personal or legitimate project-evaluation purposes. You may not reproduce, republish, sell, modify, or commercially use our content without written permission.
Acceptable use
You may not misuse the website, attempt to interfere with its operation or security, introduce malicious code, scrape or harvest information in a manner that disrupts the site, impersonate another person, or use the site for unlawful purposes.
Third-party links and services
The website may contain links to third-party websites or services. We provide those links for convenience and do not control or guarantee third-party content, availability, security, or practices.
SMS terms
Visitors may opt in to receive conversational text messages from DFW Excavation about a project inquiry and potential or current work by following the process at dfwexcavation.com/text-us. By sending the prefilled opt-in message, you authorize DFW Excavation to send text messages to the mobile number you use for that conversation.
Message frequency varies based on your inquiry and project activity. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of purchase. After an opt-out request is processed, we may send a one-time confirmation that you have been unsubscribed. For information about how we handle mobile information and SMS consent data, see our Privacy Policy.
Disclaimer and limitation of liability
To the fullest extent permitted by applicable law, the website and its content are provided “as is” and “as available” without warranties of any kind, express or implied. DFW Excavation does not warrant that the website will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by applicable law, DFW Excavation will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use this website. These website limitations do not replace or alter any rights, remedies, warranties, indemnities, or limitations contained in a separately executed project agreement.
Governing law
These website terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising solely from use of this website will be subject to applicable Texas and federal law.
